Please read these terms and conditions carefully as booking a place on any of the WeatherHolidays (Wxhols Ltd) tours constitutes an agreement to them in full.


"We/us" Means “Wxhols Ltd”


"The Event or Tour" Means any holiday, accommodation, activity or function organised or advertised by us.


"You" Means the person who has signed the booking form and includes all the people on whose behalf you have signed.


"Supplier" Means the company or person that is holding or providing the event or any part of it.


"Price" Means the total cost of the event.


These terms and conditions govern the contract between you and us to the exclusion of all other terms and conditions save for those implied by law, and no variation to these terms and conditions shall be valid unless in writing and signed by you and the company director.

Formation of Contract

No contract shall arise between you and us until we have received the deposit payable and we have sent you written confirmation (This can be in the form of an email) of our acceptance of your booking.



Lead Name

The lead name on any booking with us accepts the full responsibility of collecting the full balance payable for the booking and indemnifies “Wxhols Ltd” against any loss from any individual failing to pay within your group. The lead name of the group is also responsible for ensuring that all group members are aware they are bound by our terms and conditions. The lead name is also responsible for the completion of the online guest list on behalf of all persons on the booking. It is understood that those booking via email or telephone agree to, and accept our terms and conditions.



Payment & Deposits

Deposits are payable at the time of booking, and the balance of payments may be split into phases which will be detailed in your booking.


An agreed non-refundable, non-transferable deposit is payable at the time of booking.The final balance is to be paid no less than 56 Days (eight Weeks) before the date upon which your tour or event is due to start. Failure to pay by this date may result in a £25.00 per person late payment charge.


If you do not make your payments by the due dates given, then you shall be deemed to have cancelled the tour or event. Deposits are used by us to enter into the contractual arrangements on your behalf and are non-refundable. Payments can be made with a valid Credit Card or Debit Card or online bank transfers.



Outstanding balances

Wxhols Ltd reserves the right to automatically take payment using the method used for your initial deposit for any outstanding balance that has not been paid by the date it is due.



Financial Protection

Wxhols Ltd is committed to customer satisfaction and consumer financial protection. We are therefore pleased to announce that, at no extra cost to you, and in accordance with ''The Package Travel, Package Tours Regulations'' all passengers booking with us are fully insured for the initial deposit, and subsequently the balance of monies paid as detailed in your booking confirmation form. Your money is fully protected and is held within an independent Trust Account, managed by Protected Trust Services Ltd of 307-315 Holdenhurst Rd, Boscombe, Bournemouth BH8 8BX and its Trustees, chartered accountants - Elman Wall Ltd of 8th Floor, Becket House, 36 Old Jewry, London EC2R 8DD.



Cancellation by us

In the event of Wxhols Ltd (Weatherholidays) cancelling the tour that you are booked to take part in, we will use our best endeavours to re-arrange your booking on a mutually convenient date or will provide a full refund of all monies paid with respect to the booking. In no circumstances will Wxhols Ltd (Weatherholidays) be liable for any other subsequent or consequential costs or claims for compensation.



Cancellation by You

You may cancel your booking within a period of 7 Days after the initial deposit however, this initial deposit is non-refundable. After 7 Days, you may cancel your booking however, all deposits and (if applicable) any additional payments made to date on the booking are non-refundable. All cancellations must be made in writing from the lead name on the booking (this can be within an email or support request from our website). After 7 Days, the amount of the cancellation fee is calculated according to the date on which we receive written notice of your wish to cancel.


The cancellation schedule is as follows (days before the tour or event begins):


More than 180 days: Loss of deposit
150-180 days: Deposit + 20% of the final balance
120-149 days: Deposit + 30% of the final balance
90-119 days: Deposit + 50% of the final balance
56-89 days: Deposit + 80% of the final balance
30-55 days: Deposit + 90% of the final balance
Inside 30 days: Deposit + 100% of the final balance



Accommodation

If accommodation is included in your booking, the accommodation type and sharing basis in the booking will be applied on a best-effort basis. For instance, if you have chosen and paid for a single room, we will make every effort to accommodate that, but it may not be available for all nights of your event or tour. Where named accommodation is part of the package, it may remain confidential to us and only be disclosed to you upon receipt of the completed secondary deposit and written confirmation from the supplier.



Meals

Breakfast is not included with accommodation bookings unless otherwise stated. If included, the type of breakfast you will receive will be confirmed upon arrival at your accommodation (this may be hot or cold). If included with your booking, any restaurant meals may require a pre-order to be completed by the lead name of the group. This should be completed and returned to us or the venue as required. If a pre-order has not been completed, we accept no liability for meals not provided or delays in providing the meals for you. You will not automatically be sent any menus, and menus may be of limited choice from a set menu. We will endeavour to meet any specialist dietary requests for any member of your group but cannot guarantee these requests. We accept no liability if our suppliers are unable to meet these requests in advance or once at the venue. If your group arrives late, then we accept no liability.



Tour Costs

Unless otherwise advertised, the price of our tours and events do not include food, flights (or other forms of transport) to or from the meeting point, travel insurance or any other incidental costs you may incur, such as souvenirs, extra items of clothing etc.



Alterations + Surcharges Applied By Us

If due to circumstances beyond our control, it becomes necessary to make any alterations to the tour or event (including price rises due to increased costs), we shall inform you of the changes as soon as possible. You must pay any additional cost due to such changes. If the changes are, in the view of Wxhols Ltd, so substantial as to materially alter the tour and you are unwilling to accept them, then you may cancel your booking, and we will give a refund of respect to the monies you have paid to us for it (In this instance we will not be liable for any other subsequent or consequential costs or claims for compensation).


Surcharges may be applicable where an event requires a minimum number of participants to proceed, and the group does not meet this minimum number. This could lead to the cancellation of the event for which we are not held responsible, and alternatives may be offered of equal or greater value. If this value is greater, then you must pay us the difference in price. If the final number of a group is an odd number, then a single supplement surcharge may apply if the booking or an event (including accommodation) is number-dependent.



Safety

The team will brief you on safety during your tour or event; please take heed of this and any instructions they give you.



Voluntary early departure

Should you wish to leave a tour or event early for any reason, Weatherholidays will not be liable for any additional costs you may incur, including but not limited to transportation and accommodation. In addition to this, no refunds can be given for an early departure.



Your obligations

You shall at all times behave in a safe, responsible and courteous manner; comply with all instructions, regulations and codes of practice issued by our suppliers or us; ensure that you comply with all age restrictions imposed by our suppliers; ensure that you comply with all arrival times. If you breach these obligations, we may cancel or curtail the tour or any part of it, and in those circumstances, you shall not be entitled to any refund.


Many of our tours and events are a shared experience. If your behaviour negatively impacts other guests, the team will ask you to remedy this. In the case of ongoing issues and a refusal to remedy any behaviours which are causing issues, Weatherholidays reserves the right to ask you to leave the tour. At this point, Weatherholidays will not be liable for any subsequent costs you may incur and will not refund the cost or part cost of the tour.


Should your behaviour seriously impact or endanger team members, other guests or those in the vicinity who may not be connected to the tour, we may, without warning, ask you to leave the tour. Again, in this instance, Weatherholidays will not be liable for any subsequent costs you may incur, and no refunds of the tour cost will be given.


Examples of behaviours which may result in you being asked to immediately leave the tour include, but are not limited to:


Violence, drug taking, drinking or drunken behaviour whilst in or around the chase vehicle, repeated refusal to return to the chase vehicles in a timely fashion during the chase, theft, hateful or abusive language.



Force Majeure

Cancellation refunds may not be payable in the event of circumstances that are beyond the control of Wxhols Ltd – these events may include (but are not limited to) war, riots, civil strife, terrorism, industrial disputes, natural (or industrial ) disaster, fire, WHO or foreign office advice, adverse weather condition, airport closures/delays or epidemics.



Travel requirements

It is your responsibility to ensure you have the correct documentation to travel, and no refunds or compensation can be offered should you be unable to travel due to issues arising from this.



Accommodation and other third-party suppliers

We use third-party suppliers during the course of the tours (such as hotel accommodation), and although every care is taken to ensure that they are of good quality, Weatherholidays does not accept responsibility for inconvenience/costs that may arise as a result of being dissatisfied with such services or products. Weatherholidays will also not be liable for any additional costs or claims for compensation as a result of the quality or actions of a third-party supplier. You will also be bound by any separate terms and conditions imposed by the third-party suppliers as part of their booking process and policies.



Our Obligations

We shall take reasonable care and skill in arranging the event and comply with all applicable laws in relation to an event or tour.


Whilst we will make every effort to in terms of timings and positioning, there is no guarantee you will witness any weather-related phenomenon during your particular tour or event (including but not limited to thunderstorms, lightning, tornadoes, or northern lights). In this instance, no refunds can be given, and we will not be liable for any other subsequent or consequential costs or claims for compensation.


Photographs and illustrations we use on our website and in literature (including quotations) we send you are for marketing purposes and may not entirely represent the actual products received.



Customer Feedback

If you have a problem whilst on your booking, then you must contact the appropriate person(s) at the earliest opportunity. Unless there is a valid reason why you did not report your problem to the appropriate person(s), we will not consider ourselves liable for those complaints. If they are unable to resolve matters to your satisfaction, then you must write to us within 7 days of the conclusion of the event. No complaint will be accepted outside of this time frame, thus deeming you fully satisfied with all aspects of the event and the services we have provided to you. We will acknowledge any correspondence within 5 working days and endeavour to deal with the complaint as quickly as possible.


Contracts (Rights of Third Parties) Act 1999


No part of this agreement shall confer on any third party any benefit or right to enforce any terms of this agreement.



Jurisdiction

This agreement shall be construed in accordance with the laws of England and Wales and the courts of England and Wales shall have exclusive jurisdiction to deal with any disputes arising between you and us or our suppliers.


We require all guests to take out adequate travel insurance for the duration of their trip and may ask to see the policy certificate prior to the tour beginning. We strongly advise you to take out full travel insurance at the time of booking, which may cover you for the cancellation fees (as per the schedule above) should you need to cancel your place.



Changes to these Terms and Conditions

We may need to make changes to these terms and conditions. Any changes can only be made by us and not any third-party member. We reserve the right to amend or improve these terms and conditions without prior notification. When it is necessary for changes to be made, we will forward you a copy of these changes, and all reservations will abide by the amended terms.


In addition to these terms – if booking on any of the tours, you do so on the understanding that a film crew and/or photographers may be in attendance to film the tour. Your agreement to take a place on this tour will constitute your agreement to allow them to film you during the course of the tour, you are granting Wxhols Ltd (Weatherholidays) and the filming company a worldwide perpetual, royalty-free, non-exclusive license to reproduce, modify, make available, distribute and sublicence the content of the film.
